Brad W. Hissing focuses his practice on bankruptcy and insolvency matters primarily in the area of Creditors’ Rights and Bankruptcy Litigation. His practice also concentrates in the areas of Collections, including Commercial Collections and related litigation. Mr. Hissing represents the interests of businesses and individuals as creditors in Chapter 7, Chapter 11 and Chapter 13 bankruptcy cases as well as in state and federal courts. He also represents Chapter 7 Trustees in the recovery of assets and other matters in the bankruptcy cases in which they are assigned.
Mr. Hissing’s bankruptcy litigation experience includes the representation of secured and unsecured creditors in all aspects of bankruptcy cases including litigation of adversary proceedings and contested matters, including fraud issues (discharge and dischargeability) and matters pertaining to avoidable transfers (preferential transfers and fraudulent conveyances) as well as litigation concerning the automatic stay. His practice also includes the representation of his clients in claims-related matters, including the preparation of proofs of claim, the allowance of such claims, and the valuation of collateral securing such claims.
Mr. Hissing also represents creditors in business litigation matters pertaining to compliance issues, including sanctions litigation as well as advises his creditor clients as to suggested best practices for risk management and compliance with statutory and regulatory requirements.
Mr. Hissing is admitted in all State and Federal Courts in Florida. He is a nationally recognized lecturer who has spoken at numerous seminars and conferences on issues involving bankruptcy practice and procedure from a creditor’s perspective, including panel discussions at the National Association of Chapter 13 Trustees Annual Conference and the American Bankruptcy Institute Alexander L. Paskay Memorial Seminar on Bankruptcy Practice and Procedure. He is also a past Board Member of the Tampa Bay Bankruptcy Bar Association and is the author of several articles pertaining to bankruptcy and collections as published by the Commercial Law League of America in the Commercial Law World (CLW) Magazine.
Mr. Hissing was born and raised in Miami, Florida. He is involved in several community activities throughout the Tampa Bay area, including the Humane Society, the Tampa Audubon Society and Feeding Tampa Bay.
